Driver Why was he allowed to make a 2nd statement?

The driver that caused the accident on 18 January 2013 on N1, why was he allowed to make a statement on the day of the accident and a 2nd statements two months later? He told my husband he did not see him? he told my husband that he caused another accident two days prior in Springs Jhb? why did his superior ask whether he was drunk? the assessor was so surprised that my husband survived the accident because of the way the car look. why did the insurance accept my husbands statement and ask the driver to redo his statement? the lady at the insurance alexia Miller, Mutual and Federal Negotiator, what did she negotiate? she sent a one liner that my husband was found more liable? she is rude and evasive. how did they get to that verdict? my husband has a drivers license for 34 years and code 14 for 20 years, he is an assessor for heavy articulated vehicles and driving equipment. He has never been involved or caused any accidents and his vehicle he had for 13 years accident free... that i am sure speak volumes...
