Cheap cartridge bad service

Bought R 129-00 cartrige from shop and returned it within 30 min on the 13/02/2013. When I opened the cartridge it leaked and every thing was full of black ink. I did not want to put a leaking cartridge in my new Lexmark printer and took it back. I took photos of all the ink messed and marks on my desk and even photos of his hands full of ink when he checked the unit. He refused to refund or replace.
It is now 6 days later and hesaid he would send it to his supplier and deliver it to my door within 48 hours. He now says I did not listen and must wait with no explanation
