Deposit not returned

Dealer not returning part of my deposit. Dealer indicates that he is within his rights to withhold deposit but when I request information on where the amount is indicated on the OTP he cannot produce this. No "withhold tax" ever discussed but the dealer is indicating that is how it works. How does he determine that he can withhold exactly 14.5. percent of my deposit? I have the OTP but the dealer is not producing his copy. The dealer did not deliver the vehicle and was unable to meet his commitments to the vehicle's seller and hence communicated that he was entitled to keep my deposit even though no value is stated on the OTP or ever discussed.
