Peugeot 207 Sold to me with a faulty gear box

I purchased my used car from Imperial Select Pinetown in November 2012. In early February the gearshift became stuck in neutral, and I discovered that the gearbox had clearly been worked on previously. Upon enquiry, Imperial (Thomas George & Len Tolmay) informed me that they are not obliged to inform customers of any repair history, and that the gearbox would have been covered by a warranty had I taken one.
Imperial confirmed that they only offer a standard 1-month warranty and reminded me that the extended warranty offered to me at the time of purchase was not taken. I had been informed at the time of purchase that the vehicle would be subjected to a 101-point check and be roadworthy. If I had been made aware of the repair history at the time, I may well have wanted to take an extended warranty, or more likely not even purchased the vehicle at all.
In performing this 101-point check Imperial either didn't notice that the gearbox had been worked on, or they did but decided not to tell me, and I would like to know which is the case. According to the manufacturer even if I had taken a warranty it would've been useless as the gearbox had been worked on, so I would like clarity on this
