McCarthy VW not homouring written agreement

Cars & Transport

In June 2012 I purchased a silver Golf 5 GTI from McCarthy VW - Pine Street. I was in the process of trading the car in for a Golf 6 GTI, only to find out that on inspection of the vehicle, Edenvale VW (Gauteng) have found that majority of the vehicle was re-sprayed. The deal has fallen through due to the car being re-sprayed. When I purchased the vehicle in June 2012, I asked if the vehicle had been in any accidents/if there were any major problems and I was told that there was nothing wrong/no accidents. As a man on the street, I am unable to identify if a car had been re-sprayed/involved in an accident. What is quite surprising to me is that fact that you were not able to pick up the problem on the Golf 5 GTI, yet on the POLO which I traded in, your inspection team picked up that there was paint work done on the vehicle. The dealership asked me to take the car for an evaluation to 1 of their approved panel beaters. The panel beater confirmed that most of the vehicle has been resprayed. The dealership agreed to take the car back and settle the finance house, however they have not done so as per their written confirmation stating that they would. Now the finance house is calling me for payment.
