Damaged goods never returned after collected

My TV cellular phone went in for repair after it dropped. Bayport had sent a courier service to collect the phone. After that i heard nothing, i couldnt get hold of bayport. Yet they have handed me over to lawyers and have failed to advise the lawyers or the court that they never returned my cellphone and that was the reason i havent paid the account. how can I pay for something I dont have. Now I have both a bad name and know phone. PATHETIC
