Complaint against: Momentum Short Term Commercial insurance
I hold a policy for Public Liability with the extension for 'Custody and control' which according to my schedule covers me for 'damage to property under your custody and control where you are legally liable for any damage caused while performing work to property belonging to other people'. I specifically took the extension for cover for 'Liability - Custody & Control'!! I am in the business of maintenance and construction of fuel system and at fuel stations, and do not own any stock, I work on customer's assets / goods. The only exclusion is for stock (I don't own any) and is only while no work is being performed on those goods, which was not the case, as the job was not complete and invoiced.
So why then, when I was working on a site, and I moved the pumps from one site to another, and I was involved in an accident, resulting in the goods I am legally liable for to be damaged, does Momentum does not want to pay? My customer has provided me with a letter that they hold me legally liable and that their insurance does not cover this incident.
In the policy wording there is NO EXCLUSION for property I am leg
