My car being in possession of third party

My vehicle has being in arrears for the past 9 months of which I have being unemployed but seeking for a job. My challenge has being that my car is in the possession of a third party who keeps on promising to bring it back so that I can hand over the vehicle to the wesbank agent, it has being unfortunate that he still has not brought the vehicle back. I send Wesbank an email requesting them to call me and to make possible arrangements to pay the vehicle and requested that they give me till Friday this week to try and pay the arrears and get hold of the vehicle. Now my challenge is both the legal representatives I spoke to does not want to grant me a chance to make payment arrangement and threaten to lay a criminal charge against me which could lead to 12 months in prison if I do not surrender the vehicle even though I am willing to make arrangements to start paying the arrears and instalment from end of September. I acknowledge that I am liable for the vehicle and know that I would get black listed but is there no way they can try and make arrangements for payment.
