Auto And General Refusing to pay out claim

I was involved in an accident on 15/12/2012 after battling with Auto And General/African Independent/Telesure for more that a month, the finality come back to me saying that the will not pay out the claim because the policy premium was worked out at 7 years comprehensive cover and they can only find 4 years comprehensive cover that i was specified as regular driver. The company i work for gave me a car since i started working there in December 2002 of which i was the regular driver, unaware that the car was insured as n "pool" vehicle and i can not be specified as a regular driver. So Auto And General/Telesure says they still cant pay out the claim because i am now only in the 4 year comprehensive cover range and there was a claim in 2008. Is this a valid reason for not paying or are they just trying to get out of it because i have only been insured with them for 8 Months?
