Some years ago, due to circumstances, I defaulted on honoring my payments which resulted in a judgement against my name. In 2010, I was in the position to settle the outstanding amount in full. I called Standard Bank, and was informed of the amount to pay, which I subsequently paid. About two months ago I applied through my attorney to rescind the judgement, which was refused by Standard Bank. The reason being that Standard Bank at the time awarded a "compromised settlement" meaning that according to them, I still "owe" an amount of approximately R8600.00. My concern is the following: At no stage was I (1) informed that it was a "compromised settlement", (2) did I sign documentation informing me that by paying the specific amount there will be consequences later on or (3) were I told that there are consequences attached to it. I also at no stage ASKED for a reduced / compromised settlement - I paid what I was told to pay. I am now told that I have to first pay the outstanding amount in full before the matter will be considered any further. To my opinion this is highly unfair. How is Standard Bank going to assist me in solving this matter?
