Blackberry phone upgrade

On the 1st December 2012 my mother upgrade her phone to Blackberry, from day 1 this phone had a problem charging, My Mother went back to MTN on the 3rd day, and they told her that there is nothing wrong with the phone, (my mother also got a hearing problem) so she went back home, the phone still had the same problem, on the 6th day she went back there and they took out the memory card saying there is a virus on the memory card and that this is the only problem. Because of my mothers hearing problem she waited till I came to Klerksdorp to go with her to the MTN store, Now the 7 day returning period is over, so the are not allowed to change the phone, to me it is unfair, this phone was taken back 2 times in the first 7 days, Today is the 17 January, we could not use that phone up till now, come the end off the month they will take your monthly premium but you have no phone.
