Resealing a PC Game and reselling as NEW!!!

I purchased a new copy of Crysis 3, sealed and everything. When i got home and UNSEALED the game box put the disc in the DVD Drive and tried to activate the game it says that game has already been activated? Can someone please explain how this has happened? On closer inspection the discs look used as they have some minor scratches on them? I would like to ask that this issue be resolved as soon as possible, it is not ethical to resell these products in this manner. I will be elevating this matter to the local EA support team as well.
