Not returning deposit

A deposit was paid on a new property, the buy being subject to bond approval from bank. The bank did not approve the bond, which was on the 13th Oct 2012. In November 2012 I asked for the deposit back, as per our offer to purchase contract.
After numerous emails and phone calls, I received an email on the 16th of Jan where they promised me the deposit will be returned before the end of January.
I am still waiting for the money, after a reminder to them on the 5th of February, and will now have to resort to legal action.
