NO Service and dont keep to their promises

I have a TOMTOM Golive 1005, the battery started to give problems and the device switches doesn't charge. I have contacted the TOMTOM call centre regarding the matter, I was told that these devices carry a 2 year warranty and I must take it to the retailer I gave bought it from and they will issue an exchange unit. I went to Makro Centurion and took the GPS to the TOMTOM representative on the floor, she told me they don't exchange units and it must be sent away for repairs, conflicting information to what the call centre told me. I wasted and hour of my time to get it booked in, I thoroughly explained the problem to the representative and she got a DER4846429 number on device serial SP5152G00517. Today I went to fetch the unit, all that was done is they have reloaded the image, this resulted to all my waypoints being lost and I still sit with a device with a battery problem. In fact I am worse off than I was prior to booking in the device.

I hereby request that TOMTOM keep to their initial promise and REPLACE the unit as it is very clear that they cannot repair the unit or follow instructions. I am not willing to waste more time on this matter.
