Carpenter fails to refund client

Mr Raul Gimenez was contracted to do flooring and carpentry work at our residence whilst we were overseas. He requested 70% payment upfront as he undertook to complete the jobs in our absence. We received news from our housesitters that he had not commenced work and continued to change the commencement date.By the time we arrived back he had still not started and kept pushing the commencement date forward. We had no alternative but to cancel the job and find another more reliable contractor. He committed in writing to refund us after the 25 April 2013. Raul Gimenez had also been commissioned to build office furniture for our home study. Once again 70% was paid up front. After we Cxd the second and third job, he decided he was not prepared to install the office furniture. After much begging and pleading he agreed to allow us to collect the "completed" office furniture ourselves and do the installation. The furniture arrived incomplete, uninstalled, damaged and missing parts.
He is now holding our 70% deposit for the 2nd & 3rd job until we pay him for the office furniture. We have requested a credit note for the office in order to finalize this after and be refunded. No luck yet!
