Selling Games illegally or Not?

My son bought a PS3 Game that clearly states on the box that it is not to be sold Separately. I questioned this a week later and was told that they had run out of the others so they simply sold the "Not to sold Separately") Surely this is not legal? Anyone who has any advice on how to pursue this as BT Games do not respond to Hellopeter would be greatly appreciated. As BT games have simply walked away from the issue.
