I have made a full payment on a KIA Picanto on the 14.08.2013 to the KIA-The Glen Dealership. I requested the car to be registered before I take delivery due to insurance purposes. The requested date for delivery for the was the 17.08.2013. On the 16.08.2013 I visited the dealership to check if everything was in order. On my arrival I have discovered the car had a scratch and dent on the back door. The sales consultant suggested that the scratch be buffed up and dent worked on. I refused the proposal. She then recommended that the car to be replaced with another one. The proposal was accepted by myself. I received a call from the sales consultant on the 19.08.2013 stating that she was finding it difficult to source another car with the same colour from me. She suggested if she could replace it with a different colour or provide me with a service plan as compensation or provide me with a refund.
The sales manger has rejected the options and provided me with the following:
a) They will fix the scratch and dent and I must take delivery of the car
b) I am responsible for a 20% payment due to depreciation if I want a refund.
c) Another car with a different colour is not an option.
