Claim over a phone insurance is not responding

I lost a phone bought over seas by my mother in law. Phone was not configured in SA. Now the insurance says they can't put my claim through as the phone is not blacklisted. MTN can't pick the IMEI number as it was never configured here n now we did an affidavit to show that the phone was valid as we still have the box. Still they are decline n it's been a month since they said they will get back to me with an out come from their top management.
