New Phone Faulty

I am a customer of Vodacom for many years and have just upgraded from a BB8520 to BB 9320. However, this phone is a constant nightmare. It is only a month old, yet it is absolutely slow and it freezes quite often. As i send this email, my fone is actually frozen for the last 15min, which pushed me to sending this complaint.

I did call Vodacom Customer Care a few days ago, and the consultant said that i should take the phone into the vodacom store, and they will send it for repairs.

Firstly, being a month old i still consider it a new phone.
Secondly, the contract is for 24 months. i am not prepared to start of this contract with a phone that is a month old, that needs to go for repairs. If the phone was more than 3 months old and then theres a problem, i would understand, but not this.

And i have to be without a phone for about 7 weeks due to it going for repairs, for a problem that I am not responsible for but a manufacturing problem.

So basically, i dont want my phone going for repairs, i should be entitled to a new phone.
