Disclosure of Terms and Conditions

I am Highly discusted. I have 2 Vodacom Contracts and my Fionce 1. The day he upgraded his contract in store at Vodacom Klerksdorp the consultant asked him if he would like insurance on then Cell phone for when its is, damaged ect. He said yes he would. We also told the consultant that the phone will be used by me and not my Fionce as I will be using my own sim card. We were under the impression that the insurance was for the phone as that is what we were told. To make a long story short the Blackberry Torch was today and after informing Vodacom they told me that the insurance will not replace the phone as the contract simcard was not in the phone at the time it was. Now I am confused as I was covering the phone against not the simcard and nowhere were we informed that the contract sim should be in the phone for the cover to work!!! So now my question is this I was not paying for the simcard to be insured but the phone. The consultant I spoke to at the call centre today advised me that I should have asked!!! Is it not the responsibility of the provider that is selling the insurance to disclose the terms and Conditions to the customer???
