Efuse to exchange new phone with a bad battery

We renewed contract and got a new phone, unfortunately there is a fault with the battery, it runs flat within 2 hour and it gets very hot when charging. We went back within 5 days and they refuse to replace the battery or phone, but when we got the phone we where told if we have any problem they will replace the phone, now they say it has to be send away for up to two weeks to be fixed or replaced. We didn't buy a new phone to be without one for two weeks and they don't even offer a lend phone option.
