New phone giving problems

I went to Vodacom in Westgate to upgrade my contract and to get another one. On advice of the consultant helping us we took the new curve. About the 4th day we noticed it freezing and didnt want to swich on. On the 6 day it got even worse and my fiance who is using it took it back to vodacom. When he arrived they where going to replace it cause the software crashed but because of a small scratch on the back they didnt want to. I told hom to tell them to just replace the two covers of the new one with the scratched one and they wernt willing to assist. They apparently fixed the phone. 2 to 3 days later the phone was even worse all the buttons wasnt working and it kept on freezing and so on. We went back and they said that they can only send the phone for repairs. When i mentioned the covers switch they said that if we had two of the same phones they could have done that but our 7 days has passed. Why couldnt they have done that then when we came the first time, they would have given him a new phone just there and could have swiched but now according to them its passed our 7 days. What if we get the phone back and a week later it gives they same problem this is not acceptable
