A brand new ipad for repairs

I took a phone on contract with vodacom 2 weeks ago and started to actually notice that the ipad has got a defect/fault.

I wanted to sync my ipad to itunes on my laptop but everytime it was getting crashed, i was getting a error message saying file system is corrupted in ipad. I went to vodacom shop and they told me to go to Vodacom Data, Vodacom Data told me to go to Vodacom customer services. I have been running around from one vodacom shop to another but without any help as their technicians were unable to help. Finally i went to istores and they told me this ipad is faulty. I bought the ipad on 25th Jan 2013.

I returned it to vodacom on 31st Jan 2013, they said they will give me ipad after loading the software as its mentioned in contract, if its s oftware issue they wont give me a new ipad but within 5 days. Its 9 days already and I am yet to receive any update from their side, Vodacom has clearly breached the contract by not returning the ipad within 5 calendar days, its highly unacceptable. Store manager Shoni and the other guy who deals with repairs is saying they are helpless but its their responsibilty. Hoping to get justice soon.
