My cost for Vodacom's fault

I took out a Top Up contract in January 2013 with a Blackberry 9320. Since then, my Blackberry has been rebooting all the time, the internet service works occasionally (even though I am paying for RIM but not getting the service). I've taken my phone in 3 times for these problems, to be told they have upgraded software but the phone still gives hassles incl. disconnecting the network.

I would like to cancel this contract (mainly because the phone doesn't work), upgrade to a more expensive package so I can also get a better phone and Vodacom still wants to charge me a high cancellation fee. Why should I pay for airtime that I will never get (if I cancel my package). Vodacom terms state "payment of a reasonable premature cancellation charge" but it is far from reasonable. I am "happy" to pay the remainder of the phone charge (after discount) but, think after all of the above including the hassle of it, don't accept that I should pay the subscription cancellation charge. I'm still willing to stay with Vodacom with a more expensive package so there is no reason I should be charged for the cancellation.
