Replacing an HTC with a LATENT DEFECT

I signed a phone contract with Vodacom through Cellucity in Cavendish. An "HTC One", little did I know that the device I got had a latent defect. To start, upon receiving the phone, the box was NOT opened in front of me to show me the device (problem in itself). I took it home, charged it, and used it for 2 days and then noticed a hair-line crack across the screen (bare in mind the phone has NOT been dropped, bumped etc) I obviously took it back to be replaced and after waiting 10 days, I am told that I made 78 phone calls during the three days of having the phone (nonsense- I checked my Vodacom account online and I made 78 smses during the WHOLE of October and NOT while using the HTC which I only had from the 16th until the 19th ie: 78 smses were sent on my blackberry). Even if I sent them on the HTC, is there a usage limit?
Secondly, three weeks later I am told that Vodacom have found a "drop mark" on the phone. The phone is in their possession for 3 weeks, shipped TO and FROM JHB, and only then they find a mark. The device I handed them was pristine apart from the crack. The phone has not been replaced or fixed in 3 weeks, displaying APPALLING customer service to me.
