Once again MTN chooses to ignore the laws of the country. The Consumer Protection Act (section 14 (1)(c))requires the supplier to contact the consumer "not more than 80, nor less than 40, business days before the expiry date of the fixed term of the consumer agreement" to advise of the impending expiry including "any material changes that would apply if the agreement is to... continue beyond the expiry date". My R149 fixed monthly charge went up to R389 without any prior notification. The explanation from MTN is that the contract expired and was continued on a month to month basis at the new fee and that I should refer to the contract wording, they would not answer whether they believe that they have to comply with the laws of the country, but simply reiterate each time that it is covered in their contract. Please NOTE MTN - the LAW overrides ANYTHING that you have in your contract. You are breaking the law!!!
