M on throttle

My blackberry phone is on throttle since i received a sms on 16 May 2013. I do understand that cell c has a fair usage policy regarding misuse of people doing excessive downloads, but what i don't understand is that every month i purchase data bundles, change my tcp-apn settings on the cellphone to "internet". If i change the tcp to "internet" then BIS is not supposed to be affected if i do downloads on my phone. I also use my phone as a modem and cell c must have a system in place, besides throtling, to deduct the data that clients download from their data accounts or deduct it from their available funds. I have ported from vodacom and to be honest even though u guys has the cheapest data rates I'm porting back to vodacom. Also since i phoned the data department they always says that i am not on throttled... why do they to their clients? Never before was i given a ref nr, only this morning when one of their data consultants told me that i am on throttle, and i am thankful for this employers honesty.
