HANDED OVER FOR NON PAYMENT ON AN EXPIRED CONTRACT

So in October 2011 i opened up a one year virgin active gym contract and this was supposed to end in Oct 2011. In accordance with the consumer protection act, you cannot roll over any contract without notifying the customer in writing atleast 40 - 80 days before the expiry of the contract. Obviously, i did not recieve such a notice and was unaware of the automatic roll over. After the October/ November period, my debit orders stopped reflecting and I had thought the contract was done for sure.

Around November 2013, i got a phonecall from MBD Inc. Notifying me that i had been handed over. I was outraged and told them i knew nothing of the account. Now owing in excess of R1000. THey kindly informed me that virgin active had tried to call me once. But i was unavailable as i was working abroad.

I'm absolutely disgusted with Virgin active and have heard that my case was noth the first of its kind.

I have paid the outstanding amount with MBD Inc and plan to take action against VA for its extremely unfair business practice.
