Defected Game

I bought a non sealed game at CNA in bayside mall.
the disc was scratched badly, i told the cashier that i dont want this game scratched like this.

Seeing that the transaction was done before i saw the game they could not refund me and i had to take the same game.
The manager on duty signed my slip and said if it gives issues i can bring it back and get another sealed copy of the game.

Now the game is givving issues half way, i went back to the Zevenwacht branch seeing that it is close to my work and they said that they have to wait for another copy of the game (i am happy with this) but it has been 2 weeks with no responce and this game is now outside the CPA return policy and thus i am sitting with a defective game that can not continue.
