Faulty cell phone

On the 13.08.2013, purchased a blackberry 9810 torch for my son. he did not immediately use the earphones and the problem was discovered on ther 16th, he went back to the store and they told him they have to send phone for repairs. as he wanted to use the phone over weekend, he did not leave phone at store. took phone back on the 20th and it was sent for repairs as phone was faulty. they promised to follow up on the repairs and let me know after 7 days of waiting i phoned them. They were still waiting for vodacom to let them know. i phoned foschini on the 30th. as they said they will have the phone delivered to them that morning still no phone. i phone vodacom jhb to be told that the phone was in Dbn. I phoned Dbn Vodacom to be told that the phone is going back to JHB as they sent a refurbished unit. Paying R5000 for a refurbished unit, thats crazy. what makes me upset is that i had to make all the calls regarding the follow up. the staff promised to call me back but never do. i had to do all the follow up. today is 14days and still no phone. when i told the store i wanted a credit for phone the manager phoned me to apologise. If the phone is brand new n sealed why cant i get a crt
