BEWARE OF ESTATE AGENTS - DO NOT TRUST THEM!

Notice of cancellation of lease was given to the letting agent, as per the terms of the contract (1 month's notice). Since this was an early cancellation of the fixed term contract, it was agreed with the letting agent that the deposit paid will be used as an early termination fee to be paid to the lessor, together with the fact that one month's notice was given. The agent agreed that since due notice was given and the deposit will be paid to the lessor as an early termination fee, no further amount will be due and payable. A year after I vacated the property, summons was issued against me for two month's rent to be paid to the lessor - despite the agreement with the letting agent AND the fact that the property was leased again soon after I vacated the property.
The attorney instructed by the letting agent, issued summons without obtaining full details; in the alternative the agent conveniently forgot to mention the agreement I had with her. The attorney from Duvenhage & De Villiers Attorneys in Wellington acting on behalf of the letting agent had a very bad attitude and acted completely unprofessional with rude insinuations.
