PROBLEM WITH DEVELOPER OF COMPLEX

I am chairperson of the body corporate of a complex in Waterfall. We have problems with damp, which is due to the developer not complying with the building standards in relation to the placing of the damp course in the units as well as sub-standard materials and workmanship. We have had 3 expert companies check our problem as well as Inspect-A-Home and they all agree that the problem is a structural one. The NHBRC advised us that they can't act on our behalf because its not a structural issue. We have advised them that it is in fact a structural problem based on the reports from these companies, but they still won't assist us in getting the developer to resolve the problem. There are 29 units in the complex and 15 of them have problems with rising damp which is a direct result of the damp course being laid too low down in the foundations. There is also no cement mix in the plaster, which wasn't allowed to dry properly either before the units were painted. So we not only have damp problems, the paint is flaking off as well. The developer is totally ignoring our requests and the NHBRC aren't interested either. This has been ongoing since April 2012. Complex is 4 years old.
