We rented a place from Mems. After we moved out we struggled to get deposit back, as well as to get our TPN updated. There was no inspection done with us when we moved in, but after we moved out, there were a lot of faults. Out of nowhere photos appeared of a inspection they had done without us. Don't know when.
The Rental Housing Act of 1999 and amendments of 2008, in addition to the Consumer Protection Act and the Estate Agency Affairs act of 1976 applies.
1. In terms of Section 5 of the RHA an inspection must be done in the presence of the tenant three days before taking occupation and again three days before the expected exit of the tenant. If either of the inspections are not done neither the landlord nor his agent are not permitted to retain the deposit with regard to "damages". The landlord through his agent is thus compelled to refund the deposit within 7 days.
