I purchased a 'used' VW Polo from East Rand Toyota, Boksburg in 2011. The vehicle was from me two years later. When I tried to claim from insurance, the assessor discovered that the vehicle was classified as a 're-build', its VIN and engine number had been cloned and that the car had changed ownership 3 times in two years. The VIN and engine number of my car in fact belonged to another Polo that had been written off (crushed in an accident). This all points to the conclusion that the car was sold to me as a car. The insurance company subsequently denied the claim. We took the matter to Toyota's lawyers, who denied liability. I am now in the process of instituting legal proceedings.
Automark has a guarantee that the vehicles they sell are not. And they sell 'used cars', not rebuilds. They are in breach of this guarantee, and I am sure that I have a strong legal case against them. On a balance of probabilities, the car that they sold me was.
My issue is that there was no apology from management. The salesman was not reprimanded for not carrying out the necessary checks. Nothing happened except a denial of liability. This is unacceptable.
