Non - Consensual towing

On the 2nd of may 2015, my mother was in a car accident. My mother was conscious and asked a witness to phone me, her son. I arrived on the seen to find my mother standing against one of the witnesses car. I wanted to get my mother to a hospital causality as soon as I could. I was met with a tow truck Company by the name Botha's Towing Group. I was advised that the car had to be moved as it was blocking the traffic. A guy by the name Riaan Botha was the tow truck driver. I asked him how much would it be to town the car to my house that was not far from the accident site. His reply was it would be R 450 to tow it to there. In that he pushed a book under my hand and asked me to sign. I signed thinking that the car would be towed to my house. I took my mother to hospital and 40 min later I phoned him on 061 423 7536 to ask were the car is. A very arrogant Riaan reply in saying that the car had been towed to their yard that is meters away from accident site. I told him this was not the agreement and he said that there was no agreement. Then I asked a friend of mine to help me to get the car from the yard and I would pay Riaan the R 450 that we agreed on. He said that the car in question must stay in their yard until Monday 5th of May 2015 for further arrangement. I told Riaan that I was going to the police and he encouraged me to do so. I got the contact detail of Brigadier Manala from one of my friends that is in the towing business. I phoned him and said to meet him in an hours time. When I arrived at the police station he said that we have no case as I had signed the paper. there was nothing he could do and he said we need to go to court. Riaan didn't even allow my mother to get her personal belongings out of the car.

In my knowing I was bullied into sighing the paper (I was refused a copy of said sighed paper). I was not the owner or driver of the car as in The national Traffic Act 93 of 1996 Section 61 (3) it states that only the owner, operator or driver is allowed to sign the permission to get the car towed. In actual fact this car has been stolen.

My mother had been admitted to the ICU ward in a well know hospital in Vanderbijlpark with several broken ribs. That Sunday we were told by Constable Radebe of the Vanderbijlpark Police that it was not possible to send police to the hospital and that we cannot open a case on her behalf. I was told that as soon as my mother was released from hospital she can report the case. (We have a recording as proof) This forced my mother to ask the doctor to release her for a couple of hours to go and open the case and to go with the police to Botha's towing Facility to get her personal belongings.

Past 12 o'clock on the 5 May 2015 I received a call from Riaan that they offer us R 1000 for the damage car I must just bring the cars registration papers with a copy of my mother ID. I did not accept the offer and I asked him in what other way can we get the car. He said to pay R 5 500 to release the car from their yard.

My mother is 53 years old, a pensioner and widow that was in a critical accident with only a disability income. All that she had was taken from her by Riaan who is a gold digger and inhuman.

It has been 2 months since the accident. My mother still has not gotten her car. The police don't want to do anything. The court has said so many cases has been made against them. Either the papers dissapear, the case gets thrown out of court before the date or they just do no show up. No one wants to stand up to them. What more can I do for her?
