The Banking Ombudsman is there to protect the banks. This is born out by their procedure which is to accept the complaint, elicit a bank response and then make a decision. The Ombudsman does not follow proper rules of evidence [as used by the courts and Law Society] in that the complainant should have an opportunity to reply to the bank's response before a decision is made
