Damaged Smart device delivered

I ordered a smart device via online banking. It was delivered to me via courier service on a Friday. On the Sunday thereafter I took the device in to a cell shop for a micro sim and to have it fitted and activated. The saleslady trying to fit it advised that the sim could not go into the slot as there seems to be some fault with the slot. On the Monday I called FNB to report the "out of box" fault to the slot. However, the claim has now been rejected by FNB saying that there's physical damage to the device and they are not going to replace it. I have tried several options and currently the phone is at the Samsung repair shop and the costs of the repairs are for my account. As far as I am aware there is a policy that any device found faulty and reported within 7 days after purchase, should be replaced. I also fail to understand how a sim slot can be physically damaged if no sim was even inserted in there and never used by me. I am aware that the Consumer Protection Act is quite strict regarding this and unless FNB opts to replace the device, I will have no alternative but to turn to the CPA tribunal for assistance. Its been a month now and I still don't have a smart device.
