I have had an issue with Edcon and MBD attorneys regarding a debt that does not legally exist. MBD informed my wife that they had listed her with XDS. As a courtesy I wrote to Mr Moir on 29 October explaining that should he list my wife he would be doing so outside the law as no legal debt exists and no judgement has been legally obtained.
I received a response on 30 October that reads:
"Your message To: Alex Moir Subject incorrect and illegal listing. Sent: 29 October 2013 05:06:46 PM (UTC 02:00) Harare, Pretoria was deleted without being read on 30 October 2013 06:17:32 AM (UTC 02:00) Harare, Pretoria."
I have received a letter from Edcon confirming that no legal debt exists so Mr Moir should now take corrective action without further delay. An apology for his actions would also be in order. A note to companies that use XDS take note that XDS may be incorrectly listing people on their records that could deprive you of a legitimate sale.
