I was also convinced by Menlyn Auto to buy the Mini 'Care and Cosmetic Repair' when I bought my new Mini Cooper in Feb2013.
My first claim happened in June 2013. I also had endless problems with them (exactly as all these complaints on this website) for having numerous excuses for not settling the claim.
Long story short - I wanted out and cancel the insurance through the car dealer and request a pro-rate refund. Guess what - refund was also not possible because they have a clause in their TERMS AND CONDITIONS POLICY:
10. Cancellation. This policy can be cancelled by you, or by us, by giving 30 (thirty) days written notice to your last known address. You will be entitled to a pro-rata refund of your premium. There will be no refund where you have outstanding claims pending or where claims have been admitted.
My take on this SMART insurance is that they receive the bulk payment from the car dealer when you buy your car and wangle their way out of any pay-outs.
